Thank you for choosing to support the Duncan Foundation ('we', 'us', and 'our'). Your generous contribution makes a positive difference to people living with neurological conditions. These Donor Terms: - Set out the terms relating to making donations to us; and
- Explain how we collect, store, use, and share your personal information.
We may update these Donor Terms from time to time. We may also collect, use and disclose information to the extent applicable law does not prohibit it.
In relation to your use of our website and in relation to your interactions with us which do not relate to donations, or if you respond to surveys, please refer to our Duncan Foundation General Privacy Policy ('General Privacy Policy') and Survey Data Collection and Usage Terms & Conditions.

What kind of information do we collect? |

Information we collect may include personal information about you. The personal information we collect may include your name, address, email address, telephone number, information on your use of our services, and details regarding donation dates and amounts. |

Duncan Foundation collects and uses personal information from donors to facilitate our charitable activities effectively. We may collect personal information directly from you, including automatically, or from other sources such as third-party fundraising providers or data aggregators. Please refer to the General Privacy Policy for more information about how your personal information may be collected. |

By making a donation, you grant consent for us to engage with you through various communications channels. You can opt out of these communications at any time by using the 'unsubscribe' link found at the bottom of our emails or by contacting us directly.
In your capacity as a valued donor to us, we use your personal information for the following purposes: - Engaging with you as a prospective or current donor, including responding to inquiries, providing requested information, and maintaining communication.
- Issuing and delivering donation receipts.
- Expressing our gratitude to donors through acknowledgment letters.
- Keeping you informed about upcoming fundraising initiatives and other activities undertaken by Duncan Foundation through various means, including direct mail, email, and newsletters.
- Supporting our internal business processes, which include record keeping, reporting, and continual improvement of our fundraising, services, activities, and systems.
- To comply with our legal obligations.

In your capacity as a valued donor to us, we may disclose your personal information:
- Within Duncan Foundation for the purposes set out above;
- To third parties in accordance with the uses set out above;
- If you have requested or authorised us to do so;
- By sharing aggregated demographic information about our donor base with our affiliates, funders and partners;
- When we believe it is appropriate to comply with the law, facilitate court proceedings or to protect our rights; and

For one-off online donations, receipts are automatically sent via email once the payment is processed. Receipts for regular giving donations are issued at the end of each financial year.
To receive a receipt for payments made directly to our bank account or through POLi Payment Systems, please provide the following details in your banking transactions (Particulars and Reference) and email them to accounts@duncanfoundation.org, along with your contact details, donation date, and amount: - Particulars: Donation

If you've made an incorrect donation or wish to request a refund, please contact us within 48 hours of your donation. Your donations contribute significantly to our mission of supporting individuals with neurological conditions, and we are committed to ensuring your satisfaction. |

Opting to make regular donations to Duncan Foundation is a powerful way to support our ongoing efforts. If you choose to set up regular donations, we will automatically deduct the agreed-upon amount from your account at the frequency you've selected. The initial payment under this automatic arrangement will occur on the date of your first donation, followed by subsequent deductions according to your preferences. You have the flexibility to choose a start date for your initial donation to help you plan accordingly.
If you need to make changes to your donation arrangement, please notify us at least five (5) business days before the next scheduled donation date. Changes may involve deferring, altering the frequency, adjusting the amount, stopping individual debits, changing account details, or cancelling the automatic payment. Please direct all inquiries to us and please do not send credit card information via email. If you suspect that a donation has been processed incorrectly, please reach out to us promptly. Please ensure that your nominated account has sufficient cleared funds on the scheduled drawing date and inform us if you transfer or close the nominated account. Our system will automatically attempt to draw your donation at least three (3) more times after the initial attempt, with three days between each retry. We reserve the right to cancel your automatic payment if two (2) or more donations are returned unpaid. However, we will make every effort to contact you via telephone and/or email to arrange an alternative payment method or update your credit card details. |

Another powerful way to support our mission is by making a gift to us in your will, contributing to our ongoing efforts after your death.
A testamentary gift is free of all duties and is generally made through a 'specific bequests' or 'legacies' clause in a will. You may specify that your gift is subject to certain conditions, for example the money must be allocated towards a particular project e.g., the creation of a resource hub or to support a particular condition or region. If you change your mind about the amount you wanted to gift on your death or the purpose of that gift, you will be able to update your will at any time prior to your death (subject to you having retained the necessary legal capacity to do so).
If you decide to leave a gift to us in your will, we can provide you with some basic wording to use. However, we recommend also talking to your usual adviser whether it be a will drafter or your lawyer.
We also note that you will be deemed a donor when making a testamentary donation. However, due to the circumstances of your donation and subject to the General Privacy Policy, our use of your personal information includes but is not limited to: - Supporting our internal business processes, which include record keeping, reporting, and continual improvement of our fundraising, services, activities, and systems; and/or
- Complying with our legal obligations.
You may wish to remain anonymous. If this is your intention, please make sure this is specifically stated in your will and we will take reasonable steps to ensure your that personal information is not shared with third parties and/or is de-identified if we are required by law to disclose it.

Your personal information is securely stored in dedicated Fundraising and Contact Management Systems. Our primary donor and contact management system is Vega Works, and you can find more information about how they handle data and privacy here.
We use Stripe and POLi Payment systems for online payment processing, which follows world-class security compliance procedures. For further details on how they collect and use personal data, please refer to the Stripe NZ Privacy Centre and/or the POLi Privacy Policy.
Only staff members who require access to your personal information to process donations and operational support staff have access to these systems. |

Under the Privacy Act 2020, you have certain rights to request, at any time, access to or correction of your personal information that we hold. Consequences for failure to provide |

You may decide not to provide your personal information when making a donation, for example, where you make an anonymous donation. However, not providing your personal information may impact our ability to communicate with you about your donation including sending donation receipts and where there has been an issue with the processing of your donation. |

If you provide us with electronic contact details, you agree that we may send you commercial electronic messages (e.g., texts and emails) for any of the purposes set out in these Donor Terms. |

We reserve the right to make changes to these Donor Terms. Any changes made will be updated in these Donor Terms accordingly. |
